Terms & Conditions
These Terms & Conditions govern your use of Deckworks, a deck takeoff, estimating and invoicing application operated by Timothy Bosse, trading as Bomb Diggity Woodcrafters (Deckworks) (“we”, “us”, “the seller”). By creating an account or continuing to use Deckworks you agree to these terms. If you are using Deckworks on behalf of a company, you confirm you have authority to bind that company. If you are using it as an individual, you confirm you are of legal age.
The service
Deckworks provides deck material calculators (decking boards, joists, concrete footings and related takeoffs), estimate and invoice creation, shareable client links, e-signature approvals, job photo attachments and accounting exports. Plans and limits are described on our pricing page. We grant you a limited, non-exclusive, non-transferable right to use the service within your selected plan.
Your account
- Keep your login credentials confidential; you are responsible for activity under your account.
- Provide accurate business and billing information and keep it up to date.
Acceptable use
You must not misuse Deckworks. In particular you must not:
- use the service for anything unlawful, fraudulent or abusive, including spam;
- infringe anyone’s intellectual property or privacy rights;
- interfere with the security of the service — no malware, probing, scraping or circumventing limits;
- reverse engineer, resell or redistribute the service.
Your content
You keep ownership of the estimates, invoices, client details and job photos you upload. You grant us a limited licence to host and process that content solely to provide the service to you. You are responsible for having the rights to any content, including photos of job sites, that you upload or share with your clients.
Estimates and calculations
Deckworks’ calculators are estimating tools. Board counts, footing volumes, waste factors and costs are approximations based on the inputs you provide. You remain responsible for verifying quantities, code compliance and pricing before quoting or ordering materials.
Intellectual property
We retain ownership of Deckworks and all intellectual property in the software, calculators, documentation and branding. Nothing in these terms transfers that ownership to you.
Service level
We work to keep Deckworks available and accurate, but we do not guarantee uninterrupted or error-free performance. To the fullest extent permitted by law we disclaim implied warranties, including merchantability and fitness for a particular purpose.
Payment and subscriptions
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Billing, renewal, taxes, cancellation and refund mechanics are governed by Paddle’s Buyer Terms. Subscriptions renew automatically for the plan period you selected until cancelled.
Suspension and termination
We may suspend or terminate access for material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may cancel at any time. On termination you can export your data during a reasonable export window, after which it may be deleted.
Liability
To the extent permitted by law, our aggregate liability is capped at the fees you paid in the twelve months before the claim, and we exclude indirect, consequential or special damages including lost profits, lost data or lost goodwill. Nothing excludes liability for fraud, death or personal injury where the law does not allow it. You indemnify us against claims arising from your content, your unlawful use, or your breach of these terms.
General
These terms are governed by the laws of the State of California, USA, and its courts have jurisdiction. You may not assign these terms without our consent; we may assign them in connection with a merger or acquisition. Neither party is liable for delays caused by events beyond reasonable control.
